If you meet all the requirements of an L1A visa, you can apply for a change of status while you are still in L1B status. If you apply for an L1A visa after your L1B expires, you will have to apply for the visa at a U.S. Consulate abroad. You get a maximum of 5 years under the L-1B; you most definetly can change status while your L-1B is current to L-1A.

If your L-1A is approved, you will get two more years under this. But the most important thing is to apply for the green card once you get the L-1A approved (you don't need to file a labor cert).

You can definitely change your status from L-1B to L-1A, if you meet all the requirements. You can contact my offices for a free consultation 408-245-2416 or [email protected]
