my fiance isin detention and we have been living together for seven months can we be common law marriage

In terms of immigration, common law marriage is not recognized. If your fiancee is eligible for any type of relief based on a US citizen spouse, you will have to provide a valid marriage certificate. We would also need more information on the matter: how and when did your fiancee enter the USA? Has your fiancee ever been in trouble with the law or with immigration prior to his detention?
