Hi i want to marry my girlfriend (51) she has a tourist visa, and lives in Lima Peru. I (58) live in Houston Tx

I knew her for 5 years. Should we apply for fiance visa, or get married in Peru bring her here and marry in USA. and then apply for permmitte type of something.

I was told it illegal to Marry her in usa because of her tourist visa. but I should do it in peru what

do you think please

Charlie,

If she intends to remain in the US to marry you at the time of her entry, she will need to use a fiance or immigrant visa, and not a visitor/tourist visa. If she is here as a tourist and then decides to marry, she may adjust as the spouse of a US citizen.

Depending upon your timing, and what makes the most sense for the two of you, either a fiancee visa or an immigrant visa may make sense - the best option is going to depend upon your travel plans, desired timing, and to some degree available documentation of the relationship, although it sounds as though the two of you have known each other long enough to have substantial proof of the good faith nature of the relationship.
