Legal Question in Immigration Law in Texas

marrying an illegal alien

I have a friend who is getting ready to marry an illegal alien. He entered the country 7 years ago illegaly, and only has his mexican birth certificate and a state issued id for his verification documents. They were advised to get married and then file an I-130. On the form though it reads as if to file like he was still living in Mexico. Is this the proper form if they are married and living together here? What are the proper forms that need to be filled out? and are they taking a chance of him getting deported if they fill out the 1-130? what happens if it is rejected? on what grounds could the ins reject it other than him being here illegally? would my friend be endangering herself by marrying him? is that considered to be harboring an illegal alien? i know that htere are lots of questions.. would appreciate if someone knows and can help thanks!!!!!

Re: marrying an illegal alien

Since he has entered the country illegally..he would not be able to adjust in the USA. After approval of I130...he needs to go to Mexico...and apply for waiver and sit around for couple of months before it gets approved. He needs to have affidavit of support from the spouse as well.
