will this count as a conviction for immigration. I had a dismissed criminal charge by completing District Attorney Pre trial intervention program (6 mths). I never went to court/no plea /no trial. The probation agreement stated clearly that by entering into the program is voluntary and is not an admission of guilt and also if the probation is completed charge will be rejected/dismissed and also that the program is voluntary.

It should not count as a conviction, however, the arrest and disposition has to be revealed to Immigration on the application. It may be considered when 'good moral character' is addressed, unless it is at least 7 years old.
