Optional Training program
My Student Visa is expiring in DEc 2008, But my I-94 form has DS. now i am graduating in DEC 2007 & want to apply for OPT. I want to keep the start date of my OPT Jan 2007. Will my expired Visa refrain me from getting 12 months EAD?

If I understand your question, your visa expires one month prior to the end of your 12 month OPT. You will just need to renew it at some point during the year.
