Legal Question in Immigration Law in Texas

overstay student

Dear Madam/Sir,

My son is an over-stay in USA. He completed his schooling from there and is now studying in an university. My question is , 1- Can he get his degree after completion of his graduation or can it be withheld because he has no legal status?

2- Can he apply for amnesty to exit USA? What is the procedure and fines involved?

3- Can he get his passport renewed from his embassy with a lawyer�s help? As he has no residence status he can�t have it renewed personally.

The reason he overstayed after entering on a visit visa was because he was awaiting my legal status. I have finally been interviewed in May 2006, but haven�t received the green card as yet. On receiving the green card I�m eligible to apply for the whole family including my afore mentioned son.

Your son will be able to finish his education even without legal status. Currently, there is no provision or amnesty available so that your son can leave the U.S. If he leaves now, he will face a time bar to re-entering the U.S. He should also renew his passport - not having status in the U.S. is not a reason this can't be done.
