Do I qualify under section 245i?
I entered the US illegally in the year 1992. My dad who now is a US citizen filled a petition on my behalf on Nov. 94. My priority date is Jan 10 1995. On Dec. 6 2005 I marry a US citizen. My question is that if now that I married a US citizen, my husband can summit a petition on my behal in order for me to adjust status here in the United States without having to live the country. Am I covered under section 245i because of the old petition summitted by my dad? Or it will be better to wait for a visa available for me now under my new category which is the third category of the visa bulletin?
