Legal Question in Immigration Law in Texas
question on h1b transfer
Hi this is a bit tricky question. Assuming you are out of the status for h1b from Jan to May but get back in status by getting pay stubs from June to Aug, now you are in status, have few pay stubs, can you still transfer to another company without problem? Will the officer look at the pay stubs very closely to see if the total salary you made so far is close to your reported wage or it's highly unlikely they will notice that?

Re: question on h1b transfer
Pay stubs alone do NOT put you back in status. Any officer can request as much information as necessary to prove that you "maintained" status the entire time that you have been in the country. It's advisable that you get input from an attorney. I'm talking about having someone review the details of YOUR case specifically - not just answers from a website. You had fallen out of status. That can have serious consequences. You are welcome to contact my office to set up a consultation.
