Legal Question in Immigration Law in Texas

Removal proceedings

How can i find out if someone is in removal proceedings?

If he is, with no form of relief, is there a way he can be inmidiatly deported after serving sentence or will he have to be detained and have a hearing before being removed?

Thank you!

Re: Removal proceedings

If he is being held on a criminal charge, and the immigration charge is 'out there somewhere' - immigration rarely makes it known until it nears the release date, and then he is served with the immigration hold and removal notice. It is also difficult to find out ahead of time without alerting the authorities. If he plans to return to his native country. He can notify USCIS of his incarceration, and desire to be removed to his home country. He may want to consult an attorney first, to verify that the removal is mandatory.
