Legal Question in Immigration Law in Texas

Is it possible to switch petitioner for existing I-130 application?

My mother filed I-130 for me 2 years ago. But I think my dad has higher chance of passing citizenship exam than my mother, so I am thinking about switching the original petitioner from my mom to my dad. Is that modification possible?

I would suggest that you file with your father as petitioner as a secondary avenue. I would suggest that your mother's remain pending. If both parents are LPR, and both get approved, your mother has an earlier priority date (since filed first), but once one of them becomes a USC, the priority date is current.

Good luck.
