Legal Question in Immigration Law in Texas
Travel from the UK to the US during I130 application
My parents are in the I-130 process
(with us as US Citizens sponsoring
them to come over from the UK) and
I want to know if they can visit us in
the USA during this process (not to
live, just to visit)? They would make
sure they are back for
interviews/medicals and the physical
processing of the visa etc.

Re: Travel from the UK to the US during I130 application
They can come over if they are able to get authorization, which might be difficult because of the pending I-130. When dealing with immigration issues, you really need to adjust your focus so you can put up with the short-term inconvenience in exchange for the future benefits.
Re: Travel from the UK to the US during I130 application
Technically, the law does not bar them from getting a tourist visa; practically speaking however, it is unlikely that the consulate will give them one. A pending I130 almost instantly negates the 'temporary' intent required for a tourist visa.
