Legal Question in Immigration Law in Texas
Unusual consular processing problem
I am an atty, but have not seen this one before. My mom-in-law is a U.S. citizen. She filed all the paperwork to bring her husband from Russia. I-130 was apporved in 05/2007. He filed ds-230, paid fees etc. At this point, he sould have gotten an interview appnt at U.S. consulate. Instead, he received the forms back and a letter stating that local USCIS office requested his file back. Calling NVC and USCIS results in finger pinting: we sent the file - we haven't received the file. Does anyone know for what reason can a local USCIS request the file back?

You are right, it is unusual, but not unheard of. Someone in the investigations unit wanted the file back for further review, and then lost it. Continued finger-pointing is probably going to waste everyone's time. I would suggest filing again with the receipt notices from the earlier filing. It isn't fair, but probably the fastest solution.
