Good question. You can always apply. The question really is whether you will be wasting your money because there is no hope of approval. There are waivers available for previous deportation. The real question is why was he previously deported. Does he have a criminal record? There are waivers for that as well. Also, there are questions of evidence. How do you, and for that matter the INS, know that he was deported before? There is a lot of information to review.
