Legal Question in Immigration Law in Texas

My wife and I have been married for 3 years. My OPT status was expired in Jan 2008. I then stay in the states out of status for 2 and half years now. My wife just recently approved for her citizenship and waiting for the ceremony. We both have criminal records (Theft charge Misdemeanor B). What is the next step for me after she become a citizen. What forms should I file? (At the same time?) What is the chance for finally get approved? How long is the whole process take? Will I able to work and how long will I get the work permit? Thanks!

You'll want to file for your adjustment of status which takes 6 months.

Good Day,

Once your spouse is a U.S. citizen you can apply directly for your permanent residence as an immediate relative. One very important consideration however is your criminal background as there are certain crimes that become major issues in this process. It is advisable to discuss this with an immigration attorney who understands these criminal implications.
