If a women from Mexico that is in the United States ilegally claims to have a child from a US Citizen, what is the US citizens reponsible for. Does that women become a legal citizen becuase of the birth of the child? Is the US Citizen required to pay child support. There is no DNA test to show that that child is his. Also this women has contacted the US Army to demand child support. What can the US Citizen do?
1 Answer from Attorneys
The first thing he should do is demand a DNA test. The child either is or is not his. If the child is not his the discussion is over.
If the child is his, then the child is a citizen. The mother is not automatically a citizen or even a lawful resident. She must apply like any other non-resident.
If the child is his then child support is deductable from his military pay.
