Could be yours, could be the deceased's, could be whoever was at fault in the accident.
Re: accident auto
In Texas, insurance always "rides with the vehicle" meaning that the insurance on the car is always primary and the insurance on the driver is always secondary. If you loan your vehicle to someone and they have an accident, your liability insurance will be primarily responsible for the damages. If your policy is exhausted by payment of the limits, then the driver's policy will kick in. This is why you must always be careful when lending your car to someone. Never entrust your car to a known reckless driver or someone prone to drive while intoxicated. (Note that if your vehicle is stolen or otherwise taken without your express or implied permission, your insurance is not responsible for the results.)
