Legal Question in Insurance Law in Texas
Same accidents happening at school playground
Last year my son broke his arm at his schools playground and the school did not investigate where the teacher was at at the time of the accident. 3 days ago, he was pushed of the slide at the top, because of the slide being overly-crowed and broke his arm again and had to have surgery, again the teacheer was no where to be found, I want the school to help pay for the medical bills and I want to know what I can do about other accidents that has happened to my child and is being over-looked. I now fear for my child as he goes back to school Wednesday. What call will I get next? That he fell again and this time he broke other bones, or his neck. Please help, I have no clue on what my options are and I have contacted the School board and they have not returned my calls. I spoke with the Principal, and she said, as last year, ''I will investigate it and we do not have insurance to cover your child.'' My son doesn't even want to go back to that school, he tells me he is afraid that this will happen again. Thank you, from--name removed--very concerned and feared mother.

Re: Same accidents happening at school playground
in texas, school districts have immunity from any claim for personal injury unless it involves a motor vehicle collision. in my judgment, from a civil action stand point, you cannot bring a claim. as to the continuing incidences, i would certainly request a conference with your child's teacher and the principle to discuss the incidences.
