Legal Question in Insurance Law in Texas

Attorney fees for trial

I'm suing another driver for outstanding damages to my car due to an accident. Basically, his insurance company hasn't paid the full amount for the damage. The case is in small claims court. His insurance company has an attorney, representing him. The insurance company is trying to settle the claim. I would like to know an estimate of how much the insurance company's cost will be if the case gets to trial. They have requested a jury at the trial. (The attorney is in my city where the case will be tried, and the insurance company is in a city 3 hours away. I may subpoena 2 of the employees at the insurance company, if possible.) Can someone provide me with a ballpark cost they might incur?

Re: Attorney fees for trial

it is hard to say. alot of insurance defense attorneys are providing representation based on a flat fee as opposed to hourly rate.
