Legal Question in Insurance Law in Texas

Auto Claim

When should my insurance company offer to pay the medical billings for a accident 1-10-2006? Not my fault. It was a hit and run and they want to file it on my un/i limits. Are they going to wait the 4 years time limit? Ihave provided all of the doc's required still nothing. What do you think?? JB

Your insurer has no duty to OFFER to pay medical...Texas Supreme Court has ruled you need to prove liability and damages before insurer has to pay. Hire a lawyer experienced in insurance law and you may recover your benefits.

Such a lawyer will insist on payment and May recover more than your benefits..and don't wait for two years or more..you will probably lose ..

The "uninsured motorist" portion of your insurance policy is a contract between you and your insurance company. Therefore, violation of this contract by the insurance company (such as refusing to compensate you for your damages) gives you the right to sue your insurance company. In certain instances you are even entitled to collect penalties, interest, and attorneys' fees. You need a lawyer, however, who knows how to do all of this. Please contact our firm immediately. Have you not filed this yet? Please, do yourself a favor and get professional help. Any PI lawyer will do this for you on a contingent fee (they only collect a % of what they get for you--typically 33%) You may have already blown some time limits. Get help now.
