Legal Question in Insurance Law in Texas
I had a car accident and it was a hit and run, so I had to go through my insurance company, I only got one quote from a body shop and it was more than $5,000 in damage, the insurance ppl said that the damages were at $3,500 but it already had other hits, so the insurance company told me they would total it out at 3,500 because of the other dents (they said it was $2000worth of dents) the car is a 2009 Toyota Camry, I still don't agree that $3500 is enough even with the dents it already had, according to the kelly blue book value...how do I go about this situation?

see if they will pay you some more after you get another appraisal saying that the other dense or less than what they say they are and get the info from Carmack's an auto nation that the value of your vehicle is worth more. That they still do not come up, you have to sue them. You have to go to appraisal 1st and after you go through appraisal, give them notice of your dissatisfaction you may be able to sue them, but it depends upon the wording of your insurance policy. You should take a look at making an underinsured/uninsured motorist claim, since you were hit by hit-and-run. You may be able to recover more. If you pursue the UIM/UM Route.
