Legal Question in Insurance Law in Texas
car accident
on 10/10/07, my husband and another man was crossing a parking lot my husband looked to the left, at that time a man in a truck was coming from his right. he dropped his phone and hit. he had no ins. he tot. my car. my ins. paid 4,000 for med. and 900 for his truck. is this supposed to happen?what can i do?

Texas has required UIM/PIP unless rejected by the insured because many accidents are no fault..hence PIP..personal injury protection which pays when no fault and UIM uninsured, underinsured insurance..as in your case..and your own insurance should pay for your car, your bodily injuries when hit by uninsured as one out of four accidents are caused by uninsured..Hire a lawyer to review the facts...don't trust your insurance..we have two cases now..both cars were insured by All State in one case, both by State Farm in other..substantial damages and without a lawyer neither of our clients were paid..now they are..

It sounds like you either received uninsurance benefits, or PIP payments and collision coverage. It would be best to have an attorney look at the documents, police report, etc. It would be important to know the extent of your injuries and the value of your car before giving an opinion on whether this is "supposed to happen"
