Legal Question in Insurance Law in Texas
Car accident
I was rear-ended and went to the doctor on my own and was diagnosed with a bruised knee, But aftter second day I am experiencing alot of neck pain and headaches. I had statefarm and so did the person who hit me they admitted fault. I do not want the car back if they decide to fix it because the value will drop I owe 13600 and think the insurance should pay the whole thing off, I do not have gap insurance. I would also like to know what are my full intitelments. I do not want my insurance company to cheat me. what should I ask for in this case without having to get a Lawyer and sue?

It's impossible to tell you all the factors that go into a reasonable settlement for your injuries. A lawyer has experience in these factors. Many, if not most, victims realize more with the help of a lawyer than they could possibly do by themselves. If you are going to get what you want, I advise you to see a lawyer very soon.

The insurance caompny is only obigated to pay the value of the car. If you owe more than it's worth, and you don't have gap insurance, then you're out of luck. As for the bodily injury matter, you may be able to recover reasonable medicals, plus an amount for pain and suffering. You should seek medical assistance for the pain as soon as possible, just to make sure you are okey (and to make sure that you are not aggravating an untreated injury.)
You should not do this yourself. These cases are easy to mess up. Personal injury lawyers will almost always meet with potential clients for free, and don't charge fees unless the collect for you. I therefore suggest you meet with one to discuss your case.

You are asking attorneys, who have been to school a total of 19 years, and then, in my case, have practiced law for 30 more years, to tell you in a few sentences "what (you) should ask for in this case without having to get a lawyer and sue." You must be kidding. These cases are highly complex and the insurance company (especially State Farm) is extremely skilled in cheating you out of your entitlement. Be smart: hire a lawyer.
