Legal Question in Insurance Law in Texas

Car ins cancelling

My car ins co paid a claim & didn't tell me until afterwards. I am the only driver & was never in an accident. I found out by a letter stating they made payment on my claim. I called to let them know it was a mistake, I was not in an accident. I was told a car rear ended another car because I ran a red light & they didn't want to hit me so they stopped & were rearended She said someone got my license plate no. when I stopped in a parking lot just past the signal. I was shocked, and told them that was the craziest thing I had ever heard. I had no idea about any accident and I would have remembered running a red light and almost being hit. I asked why no one ever called me to ask me about it and they didn't know why. I was told my letter saying they paid the claim was my notification. I called my agent & he said he would take care of it. Now a year later they are cancelling my ins because of this. My agent has been replaced and the new agent says it is the craziest thing he ever heard but the company refuses to remove this from my record. I still don't even know who they paid or any which direction these cars (or mine) were traveling no names, nothing. No one can tell me. Is this legal?

Re: Car ins cancelling

Insurer can pay without insured's permission, but it must notify insured...and you need an agent who will obtain the record, and the problem with legal action..is what damage has it caused you? What insurer is this?..and it could be expensive to sue..so try to get an agent who will take care of it
