Many of the laws in Texas are extremely pro-insurance company and anti-consumer. This is one of them. When somesone else damages your car due to their negligence and your car is a total loss (the cost of repair exceeds the fair market value of the car), believe it or not, their insurance company does not have to provide a rent car to you at all! Reimbursement for a rent car is only required by law when your car is repairable, not when it is totaled. And, even when the insurance company is required to provide a rent car (when your car is repairable), the insurance company does not even have to pay for the rent car up front. They can legally require you to rent the car first, pay the bill, and then submit it to them for reimbursement. And there is not even a time limit as to how long they get to take before reimbursing you. If you are beginning to figure out that the laws in Texas are mostly written to favor insurance companies and big business, you are correct.
