If your in a car wreck do you have to get the person that owns the insurance policy of the other car to sign a waver to sue the insurance company?

I'm confused by your question. You don't have a direct cause of action against the other person's insurance company, in most cases. You can sue the other person, who then invokes insurance for the defense. If you do have a direct cause of action, you don't need a waiver.
