Legal Question in Insurance Law in Texas

denied coverage

the insurance co. i am dealing with is based in tx, yet i reside in fl; they denied coverage for anestesia and removal of wisdom teeth even though those procedures are stated as covered in the contract. when should i start seeking legal assistance, and will the ins co still be obligated to pay even after a certain amount of time, it has been 7 months since the date services were rendered, they keep denying the claim over and over without a valid reason (ie: it was denied twice because coverage ended 1/07/04 and that is actually the date my coverage began, then a third denial because ''I was previously sent an explanation as to why this claim is not covered'') I was also told I needed a letter of medical necessity, then a week later they said I didn't need it because the claim would be covered under dental; it went to dental and dental denied it, and sent it back to medical....this is supposed to be one better companies and they have done a horrible job. I don't know what to do to get them to do their jobs right, please help me if you can. thank you.

Re: denied coverage

i would consult with an attorney in your area. even though the insurance company is in texas, they are regulated by the state of florida in your instance. good luck. bill featherston
