Legal Question in Insurance Law in Texas
Dependent Ineligibility
After not attending college for the last 2 semesters our independent child -age 20- no longer qualified for coverage under our BCBSTX health insurance as of June 08. however, due to procrastination, we didn't inform BCBS, and in July she had an accident with bills totaling $20,000 so far. While we don't want our daughter or ourselves to be saddled with these bills, our biggest concern is having the insurance co. cancelling our policy after 20+ years due to misrepresentation/fraud (my husband has a preexisting condition). So the question at this point is: do we keep quiet for the moment or make an active effort to correct the mistake with BCBS ourselves, or would it be better to obtain an attorney to handle any communications with the ins. co.?

BCBS will protect itself but your reporting this to them will probably not keep the policy if they seek to defend on fraud..However, insurers routinely deny large bills..and if your H has a preexisting condition..expect a denial/dispute..
