Legal Question in Insurance Law in Texas
disclosure form
I was hit by a driver from behind while i was stopped at a light waiting for the light to turn green. The other driver was covered by auto insurance. They (the insurance company) are asking me to sign a disclosure form and consent and medical information authorization. Do i have to legally sign their form in order to collect damages? or can i write a demand letter stating that I want a settlement offer. I was injured but not serverly but i required medical attention after the accident.

The medical disclosure form will allow the insurance company to obtain your medical records regarding the accident treatment, and depending on how the release is worded, may include dates prior to and after the accident. Without the bills and medical records, the insurance company does not have information to make a settlement determination. The insurance company will pay based on the type and amount of treatment.
