Legal Question in Insurance Law in Texas
I was driving when two teenagers decided to cross the road. the speed limit was 50mph, it was 630am which was still dark at the time and there is not crosswalk where they crossed. as soon as i saw the two crossing i slammed on my brakes and the brakes locked up. while sliding towards the two, one decided to turn around once halfway into the street and go back after already being out of my way, then the other grabbed her and decided to pull her back into the middle of the street. i hit one with the front left of my car after almost being stopped, the person flew over the side of my car and jumped back up saying they were ok after i stopped which was shortly after. i had already called the police nowing it was the right thing to do. i was not cited for this, nor was she. after a week or two i received a claim against my insurance regardign the matter but was denied due to the fact it was not my fault. this person tried and tried again. once i turned 18 i was served with another lawsuit but the court date wasnt until i was already in basic combat training for the military so i was unable to appear. the judge found me 50% at fault and her 50% at fault. how is this possible?? any advice
