Legal Question in Insurance Law in Texas
If an elderly individual has had two TIAs (in three months) and been given the diagnosis of a major stroke imminent - what happens if this person has an auto accident (according to Texas Insurance Board)? Will insurance pay if the doctor has not notified DMV that license should be removed?

If cause of wreck was not a stroke, depends on who is negligent. If cause of wreck is Dr.'s negligence in permitting him to drive-whose insur are you talking about? Collision Ins- yes. Liability Ins of Dr.-prob not. Liab of strokee--elder gent prob yes if he was negligent.
