Legal Question in Insurance Law in Texas

Health Insurance

My husband was in a car accident that resulted in a broken leg. After it was healed, another unrelated infection caused an infection in his broken leg. They are now going to have to remove the plate in his leg. Would this fall under my health insurance, or would my health insurance consider this the responsibility of the automotive insurance?

Re: Health Insurance

You state that an "unrelated infection caused an infection in his broken leg." If it was truly unrelated to the injuries caused in the automobile accident, your health insurance company would be responsible for the charges. Of course, because insurance companies stay up late at night trying to think of new ways to avoid paying claims, they quite commonly point the finger at one another when they think there is any possibility of getting out of paying a claim. Therefore, don't be surprised if you have to hire a lawyer to file suit against your health insurance company to make them do the right thing.

Re: Health Insurance

File under your health insurance. If you do not have a lawyer for the accident, get one unless your husband was at fault. You may also need to make a claim under your own auto insurance..an injury like this alone is worth substantial, then with infection more..and so many other damages...Get a lawyer..we would be happy to review..but do not wait..as you may need to make your health insurer pay..they can't make you wait for the other auto insurer to pay..But they will try..
