Legal Question in Insurance Law in Texas

i was hit from behind on i-360....from an insured driver. she gave me her actual insurance card and drivers license number.

her ins. co came and gave me an estimate on my car repairs ( fair estamate)

but sent no check to me....i called ins co.

they told me they have not talk to their cust yet ( driver )

it now has been two weeks..my car still is not repaired.

why such long delay ????

Unfortunately, in Texas, almost all of our laws are stacked in favor of the insurance company. This is primarily due to the fact that the Republican party has been in control in Texas for the last 27 years, and Republican lawmakers are almost always on the side of big business and insurance companies. For example, George Bush and Rick Perry packed our Supreme Court with all nine Republican justices. One of the fairly recent actions of this all-Republican Supreme Court was to rule that there is no longer any such thing as "bad faith" on the part of insurance companies. This means that insurance companies in Texas can do virtually anything they want to without fear of being sued for bad faith, including delaying action on your claim for as long as they want to! You heard me right: they can now drag their feet for months or even years if they choose to and there is nothing you can do about it. And until we throw out Rick Perry and his other Republican cronies, this will continue to go on--and even get worse, if that's possible. Remember that the next time you vote.
