Legal Question in Insurance Law in Texas
My husband was struck by a hit and run driver. The driver was uninsured. The insurance company totaled our vehicle and paid his medical bill using our auto insurance coverage. However, we were responsible to pay for the cost of a rental car because the vehicle was totaled. The insurance company has been unsucessful in recouping or deductible and suggested we try small claims court or contact an attorney

You can sue the driver and seek to have his driver's license revoked. You should also have an asset check done on him to see if a judgment against him is collectible (unlikely.) You should also have an attorney review your settlement with the UM carrier, to make sure you didn't leave anything out.
