Legal Question in Insurance Law in Texas
Ins. adjuster stalling stolen auto claim b/c of divorce
The temporary divorce orders gave me possession of my vehicle & ordered my (ex)husband to maintain ins. coverage for it until the final hearing. The auto loan is in my name only. He is the primary insured & I'm listed as a driver. The vehicle was stolen (7-25-05) & he is the primary suspect (never charged). He swore under oath in (divorce)court he didn't take it or know where it was. He then filed a claim with the ins. co. I called the adjuster, gave a recorded statement & a signed release of info form. I've never been contacted by the adjuster, but I call to check the claim status. He's very rude & has never given a straight answer. I've left 3 messages for his supervisor - no response. 10-4-05 he said he was 'exercising the right' to question my ex under oath. He had left a message for my ex to contact him, but (ex) did not. The adjuster said he would take 'no futher action' & without a statement no decision would be made. I want to know if the adjuster can get a court order to make my ex give a statement or can I do anything to resolve this. Also, how long does the adjuster have to make a decision? I would greatly appreciate any advice on this situation.

Get a copy of the transcript of your X's testimony. Send it to the adjuster. Tell him you will be making a complaint to the Ins. Comm. for unfair claim settlement practices. Find a lawyer.
