Legal Question in Insurance Law in Texas

Can insurance refuse to reimburse me after accepting liability?

I was in an automobile in August in which I was rear-ended. It did over $6000 in damage to my new vehicle. The insurance company (United Mutual) accepted liability. They told me they would pay for damages but I would have to pay doctor bills and rental bills and then be reimbursed. I did just that. They sent a check to pay for the car's damages but are refusing to reimburse me in full for the rental car and doctor visit. They are saying the car was in the shop ''too long''. It was in the shop for 54 days (it took two weeks for them to get approval to start on it from the insurance company). I went 10 days without a vehicle. I had the rental car for 44 days. Do I have any rights? Should I get an attorney?

Thanks, Krissie

Yes, you have rights, but you may have sat on them too long by trying to do this yourself. I presume it is the other driver's insurance who is not paying your expenses; and they have no contractual obligation to you. I presume you have nothing in writing that says they promised to pay the rental car expenses and doctor visit. So, your only recourse is to sue the other driver, but your efforts have hampered the effectiveness of counsel.
