Insurance taking too long...

Need some advice on how to go about handling this situation. On October 12th of this year and my car has yet to be repaired. It was the other parties fault and filed a claim with the other parties insurance. Apparently the guys insurance is having a difficult time getting a hold of him to get a recorded statement from him. His insurance sent him several certified letters but have not responded to any of them. According to the adjuster she says they cannot go forward with the claim with out a statement. Or they have the option to not cover their insured at all. Last time I spoke with the adjuster she said if they do not hear from their insured by end of Monday end of business day, they will accept liability. Well Monday came and went and they decided to extend the time for him to respond and sent him another certified letter. I do have full coverage but I have to pay a deductible of $460. Damage to my car is about $4000 dlls. Should I wait to see what happens or go through my insurance and have them file a subrogation? Or should I call the party and explain the situation and convince them to give a recorded statement? Any advice will be helpful.. Thanks in advance..

It all depends upon how quickly you want your car back. If you are in no hurry, wait on them. If you need your car quickly, go through your own insurance, pay the deducible, and then wait on your insurance to recover the deductible for you.

You have full coverage for a reason--to avoid stuff like this. Go through your own, have them do a subrogation.
