Legal Question in Insurance Law in Texas
Life Insuance
I was denied life insurance after my husband's death from a supplemental policy I increased after he was diagnosed with lung cancer. All I know is employees received emails during open benefits season saying that one could increase their insurance without answering any medical questions. So I increased my spouse's an my coverage. We were accepted and paid the additional premiums until his death in June. I paid the additional premium from January to June. My question is should they be allowed to deny this additional coverage citing pre-existing, etc. If so am I entitled to receive at least a certain amount of the premiums back? I want to file an appeal to their decision.

To answer your question, one needs the policy and the application. You probably stated he was in "good health"...but if he had insurance before increasing, did he have cancer??? Take all the documetns and letters to a lawyer...we would be happy to review and tell you if we would take the case.

You need to read the policy and be absolutely sure that everything on there was accurate. I'd be happy to review it with you.
