Legal Question in Insurance Law in Texas
Help!!
I made a huge mistake by switching car insurances improperly and was hit by someone during the period where I apparently had ''no coverage.'' I am almost definite he was at fault but after filing a claim with his insurance, I gave them a recorded phone interview and was honest about the whole incident, and 15 days later they finally got a hold of the guy and he claims he now has a witness! I didn't know you could ''find'' a witness when it's convenient but, there were no witnesses at the scene and I saw the guy drive off b/c he didn't want the cops to show up. Anyway, of course, now the insurance doesn't want to pay and is sending me a notice that they are going to pay his claim but want my insurance info. to pay them back! What's really sad is my car received all the damage and his vehicle only had a little of my car paint on it! I don't know what to do?! Do you know what kind of recourse I have? I don't know if I can afford an attorney....

If you suffered bodily injuries, attorneys like me will take your case on a contingency fee basis. If yours is only a property damage claim, you can file a lawsuit against the other driver (NOT his insurance company) in the justice of the peace court without a lawyer for a very small filing fee. The clerks of the JP Court are very helpful and will show you how to do it. Best of luck to you.
