Legal Question in Insurance Law in Texas

Paying premiums for over five years on something I did not want.

In 1999 I filled out a life insurance form for myself and my wife in the amount of 70,000 dollars. The form was sent to the insurance company and money started coming out of my check. My wife passed away and I just found out that my 70,000 was denied and they issued a policy for 30,000 on me alone. The insurance company said they sent a letter back in 1999 that had to be answered in 30 days, needing more information on my wife. I never got the letter. We were moving at the time and the insurance company is saying they did not have our present address until we just filed the claim.

I am a normal working person. I filled out the paper, sent it in and money started coming out of my check. I heard nothing and got nothing in the mail. I plan to take them to court since they have no proof that they sent the letter, other than a copy of said letter. I also did not sign up for a 30,000 dollar policy for me. I want to run this by a jury of my peers. Please advise...

Sir, Please accept my condolences for the loss of your wife. I have a few questions regarding the policy: Did you receive a copy of the policy? Was the amount that you paid the same amount you would have been charged under the policy paying $70,000.00? Who sold the policy to you? Did you have an agent? I recommend that you contact an attorney that works with Deceptive Trade Practice litigation and insurance bad faith. You will need to bring all of information that you've received from the insurance company to show to the attorney.
