Recovery of Claim
If an uninsured motorist is at fault in an accident, and the injured party's insurance company pays the insured party for the loss, does the insurance company have a legal right to seek recovery of the claim from the uninsured motorist?

Yes. Your insurance policy gives your carrier that right.

At the co's option, yes. It's called "subrogation".
