Legal Question in Insurance Law in Texas

RV Accident

A hotel front canopy at poorly lit at night and no height clearance was stated, just ''Low for Trucks''. It looks high enough for my travel trailer RV to drive through but it got hit at the top corners and a window was broken. The hotel manager wanted me to pay for damages which I did, but I feel it was not my fault because no clearance height was marked and the area was too dimly lit. It was marked ''Low For Trucks'' at the top but the spot light beside it make it imposible to see sign at night. The manager told us that many truckers had driven through it and that we're not the first, so why didn't they correct the problem. Our RV is damage and no longer weatherproof and our vacation ruin. Do we have a case against the hotel.

Re: RV Accident

If you had insurance, the insurer should have paid for the damage to motel and to your RV..IF you were responsible...If you had no insurance, the motel does not have to pay your attorney fees for damage to your RV even if you won...
