Legal Question in Insurance Law in Texas
settlement agreement
Woman hits our vehicle. Admits to driver she is at fault. No witness, or accident report. Calls my insurance company and denies hitting us. My insurance denies claim. She sues and we counter sue. Insurance wants to settle outside of court, but she will only settle if we drop couter suit. I want to sue, insurance wants to settle and pay her(for accident she caused). Can I make the insurance take her to court or can the insurance settle without my permission?

Surprisingly, the insurance company can do whatever it wants to do, in spite of your wishes to the contrary. It has been my experience that insurance companies often settle cases they shouldn't, and deny claims they should pay. But in neither case do you have much say-so.
