Legal Question in Insurance Law in Texas
Settlement
we lost a family member in a auto accident. my family has filed a law suite against the driver that hit him, his insurance company has offered a settlement. we are all not an agreement on the settlement. Do I have to execpt their offer? and if I decline does it automatically go to Trial?

Unfortunately, you have not provided enough information for me to answer those questions. Do you have an attorney? If so, you need to pose those questions to your attorney, who will know all of the details of the case and be able to answer your questions accurately based upon "conditions on the ground." Also, the amount of your settlement may be restricted by the policy limits of the responsible party. In the end, you are never required to accept a settlement you don't want. You should, however, listen to the advice of your attorney.
