Legal Question in Insurance Law in Texas

My son is 21 years old and has not been my dependent since he was 15 years old. He lives 80 miles away and has lived with family since that time. He uses the bus for public transportation to work and school. One week when I went to visit him in December he borrowed my car due to weather. He rear ended someone and they filed a claim with our insurance company. Due to that claim (which was for $0), the underwriters added him to our policy. They are stating since he is my son he should be on our policy. We have provided his proof of residency, school, work and bank records showing he is not, nor has he been our dependent for over 5 years to have him removed from the policy. They, of course, want to charge us $500 for adding him to the policy. He does not have continued access to the car. Is there a legal course we can take to have him removed from the policy? Thanks in advance.
