Legal Question in Insurance Law in Texas
Statue of Limitation
Can someone sue you after the sttaue of limitation has expired?
There was an accident between a motorcycle and a bicycle. There was no liability insurance in force at the time for the motorcyclist...who was at fault.
However, the bicyclist failed to make all claims against the other party before the statue of limitation had expired.

Re: Statue of Limitation
The answer to the question is yes, someone can sue you after the statute of limitations has expired. However, the person sued would have a defense of "limitations" that they could plead in their "answer" filed in response to the lawsuit. The defendant could then file a Motion for Summary Judgment and could likely get the case dismissed due to the expired statute of limitations.
