I was rear-ended on 4/25/04. The lady was driving a Lexus and claims that it is her husband's car and that he had the insurance card information. I tried to contact her the next day, monday, and spoke with her husband who told me that it was her car, they are going through a divorce and he will not provide any information because he is not involved. The woman has yet to contact me. What steps do I need to take in getting their insurance information so that my medical bills can be taken care of. I was getting treatments for a strained back already, and had x-rays taken the day after the accident, and the results show that my back is worse then what it was when I first started going for treatments, and also my hip is misaligned now. Please help!

There are two ways to handle this problem. First, you may hire an attorney (who may have to file suit in order to get the Defendant's insurance information). Or, you may file the claim as an uninsured motorist claim on your own insurance policy. Once you do this, the burden is on your insurance company to prove that the other party is insured, so you can be assured that your own insurance company will aid you in getting this information from the other party.

There will be a difficult claim because you have uncooperative defendants. I recommend that you speak with an attorney as soon as possible so you can preserve your rights and get treatment.
