Legal Question in Insurance Law in Texas
Storage Unit Insurance claim
I had a storage unit (dunno if I am aloud to put the name here) and I got mold damage on some of my furniture. I had insurance coverage on it for up to $2000 dollars. Everything went fine as far as the claim going through but they offered me $749 as reimbursement for my stuff. There were 2 antiques damaged that I had appraised at $1850 total. Also a bed that a mattress store manager told me would be $899 to replace. Two smaller items. The took a depreciation cost off everything and dropped it to 1/3 or less of the cost and are using items that aren't actual replacements.All my things seem well over $2000 max and I was wondering should I get a lawyer for this or is there a quick easy answer to at least get half the cost of all my items back? Any help would be greatly appreciated. Oh and if this makes a diffrence when I asked about this he sent a email saying this..
''Since you disagree with the amount offered, your next step is to suggest what you think would be a fair settlement. 100% of your cost is not likely so we should try to meet somewhere between that and the offer we
extended.'' ''So bottom line, give me a number you would be happy to settle for and I'll see if I can justify that number using our evaluation tools.''

Read the policy...if it says replacement cost..and with the evidence you have insist on full payment. You could file in small claims court. However, if you hire a lawyer it could be he could collect the full amount, more..if the policy is as it sounds...We collect 12k on an 1700 loss from Geico for similar shenigans..but what does the policy say???
