Legal Question in Insurance Law in Texas
I have submitted a claim for a AUTO THEFT, at first I was told there was a 30 day waiting period before the insurance can make the claim payment. I found my vehicle was recover 2 weeks after the claim in MEXICO. The insurance wants me to pick-up the vehicle in JUAREZ, MEXICO, the most dangerous city worldwide. I leave messeges to the adjuster and they dont call me back. It has now been 45 days after the claim. I want my vehicle back or I want to settle the claim. Who is responsible for recovering the vehicle? Should the insurance already paid for the claim since it has been more than 30 day and the vehicle was recover in MEXICO ?

Write them that they are abandoning the vehicle in Juarez and that you will not go pick it up. Tell them that it is their responsibility to return the vehicle to you. Send a carbon of your letters to the State Insurance Commission complaining of their actions. Since I do not have your insurance policy, I cannot interpret it for you. If you do not have it in yur letter demand that they have not provided you with a copy and demand that they send you a certified copy of your policy. Read what it says your duties and theirs are in the event of loss. I do not know where you are except for the 79907 zip so it seems like you are in West Texas. Best wishes.
