Legal Question in Insurance Law in Texas
under/uninsured motorist coverage
I had a vehicle accident in which I was not at fault. The driver of the other vehicle didn't have auto insurance, so I filed under my policy's under/uninsured coverage. I have medical bills todate of $8K and mounting. My policy limits are 20/40/15. Will I be limited to the 20K or 40K? 40K is the max per incident, 20K susposely per person.

The first number ($20,000) is the per person limit; no one person can receive more than this amount. The second number ($40,000) is the total amount that may be paid toward all injured persons combined if more than one person was injured in the same accident. This emphasizes the need to have the highest limits you can possibly afford. More than 1/3 of all motorists in Texas are uninsured so your chances of being hurt by an uninsured motorist are quite high. Also be aware that your insurance company will not just automatically pay its limits. They will fight you just as any other insurance company will and you will probably need a lawyer to get the limits.
